Agriculture Accountability Act: House Bill 222 was passed during this legislative session, updating the penalty structure for violations of Delaware’s State Nutrient Management Program. The legislation was designed to modernize fines imposed on agricultural operations that contribute to pollution and to ensure that penalties better reflect current economic conditions. Under the new law, the Delaware Nutrient Management Commission may assess fines ranging from $125 to $5,000 for each agricultural pollution violation. Any fines collected by the Delaware Department of Agriculture under this program will be directed back to the Dept. of Ag and used to assist individuals in achieving compliance with nutrient management requirements. Funds may also support the demonstration and application of research and best practices that provide broad benefits to those working to comply with the law.
