House Bill 477 was introduced, but did not move forward. Lead exposure can have serious health effects on children and adults. For children, it can affect their growth and brain development, and lead to life-long health problems.
House Bill 477 addresses a gap in Delaware Code by requiring that the Delaware Hazardous Substance Cleanup Act (HSCA) include facilities with lead-based paint on outdoor structures. Current regulations specifically exempt facilities where the sole contaminant is lead-based paint, and Delaware DNREC determines the facility is appropriately regulated and adequately addressed by another state or federal agency, statute, or regulation. By bringing these facilities under the HSCA, contaminated outdoor structures would be eligible for DNREC’s Voluntary Cleanup Program, which offers the opportunity for a speedier and affordable cleanup.
